My Toll Experience

Recourse

If Toll has sold you a sub-standard house and / or refuses to make the necessary repairs. . .

Start by writing a letter to Jon Liebowitz, who is the Chairman of the Federal Trade Commission.  The FTC has advised me that they will investigate if they receive multiple complaints about a single company.  Explain in detail what is wrong with your house and / or the problems that you are having in getting Toll Brothers to repair your house.  (As an alternative, you can complete a copy of the complaint form that is located at https://www.ftccomplaintassistant.gov/.)   Attach any engineers’ reports, photos, repair estimates, and other documentation that you may have.  The more information you can provide, the more compelling your complaint will be.  Address your letter as follows:

Commissioner Jon Liebowitz
Federal Trade Commission
600 Pennsylvania Avenue, NW
Washington, DC 20580

Send a copy of your letter and the supporting documentation to each of the other four commissioners, at the same address.  They are:

Commissioner J. Thomas Rosch
Commissioner Edith Ramirez
Commissioner Julie Brill
Commissioner Maureen Ohlhausen

Then send a copy of the complaint and the documentation to each of the following:

  • Each member of Toll’s Board of Directors: Robert Toll, Douglas Yearley, Bruce Toll, Edward Boehme, Paul Shapiro, Carl Marbach, Richard Braemer, Robert Blank, Steven Novick, and Christine Garvey.  You can reach each of them at Toll Brothers’ headquarters, which is located at 250 Gibraltar Road, Horsham PA 19044.

If you are one of the people whose deposits and down payments Toll has failed to refund after denying you a mortgage or after granting you one and then rescinding it, or if you have found any inaccuracies or misrepresentations in Toll Brothers’ annual reports . . .

Send a copy to everybody listed above, and also to each of the following.  Explain to the people listed below what you believe Toll Brothers has done that violates the SEC laws, and attach all supporting documentation.  Again, the more information you can provide, the more compelling your complaint will be.  Address your letter as follows:

    Mary L. Schapiro, Commissioner
    Securities and Exchange Commission
    100 F Street, NE
    Washington, DC 20549

Send a copy of all of this to each of the other SEC Commissioners, at the same address:
